FAQ'sWhat is Conveyancing?Simply put conveyancing means the process whereby ownership of property is transferred from the seller to the buyer on the purchase of real estate. It has long been the exclusive field of Conveyancers and Lawyers. However, legally there is nothing to stop you doing your own conveyancing. The conveyancing process includes steps to make sure the transaction is correct for both buyer and seller, and that any outstanding monies, such as rates, taxes and levies, are cleared at settlement. The basic conveyancing process is really quite simple. In a ‘nutshell’: 1. The seller (vendor) prepares a document called a “Vendor’s Statement” Tips for do-it-yourself conveyancers*If the other party is not acting for themselves, you will deal with the appointed solicitor/conveyancer noted on the Contract *When you correspond with the other party or their solicitor/conveyancer: *ALWAYS do it in writing. If you reach any agreement with anything by telephone, *ALWAYS confirm this in writing. *In all correspondence, include: *Their reference to the transaction *The name and address of the vendor and the purchaser *The person’s name in the solicitor/conveyancer’s office who you are dealing with. *Keep a copy of all communication. *Keep a diary to record all communication, such as telephone calls, emails or inspections. *Don’t expect the other party’s solicitor/conveyancer to help or advise you as they are not acting on your behalf |
